With its decision No 6075/2022, the Athens Court of First Instance put an end to the father’s long legal struggle to have his son’s custody taken over by his mother, a former drug user. After the death of the latter, custody of the child was taken over by her mother and the child’s grandmother, who refused to hand over the child to the father, who had moved from Athens to another country, where he was active professionally and had created a new family. The Court, since no reason for the father’s unsuitability to exercise full parental responsibility after the mother’s death was suspected, granted the father’s request for custody and the child to be given to him and rejected the contrary request of the grandmother, who wanted the child to continue to live with her in Athens.
